Please read these terms before using Waken: Alarm & Morning ("Waken", "the App"), made by AlcStack Dev ("we", "us"). By downloading or using the App, including Waken Pro, you agree to them. If you do not agree, do not use the App.

1. Who can use Waken

You must be at least 13 years old (or the minimum age of digital consent in your country). If you are under the age of majority where you live, a parent or guardian must agree to these terms and approve any purchase.

2. Using Waken

Waken is an alarm app with optional wake-up missions. We give you a personal, limited, non-exclusive, non-transferable, revocable license to use it on devices you own or control, for personal, non-commercial purposes, subject to these terms. You are responsible for how you use it and for keeping your device in working order.

3. Waken Pro

Waken is free with a limited number of alarms. Waken Pro unlocks extra missions, multiple missions per alarm, custom sounds and wallpapers and more alarms. Pro is offered as an auto-renewing monthly subscription, an auto-renewing yearly subscription, or a one-time "Lifetime" purchase. What is free and what is Pro may change over time; changes do not take away Pro features from a plan you have already paid for during its paid period.

4. Payment, renewal and price changes

Purchases are made through the Apple App Store (iPhone) or Google Play (Android) and are charged to your Apple ID or Google account when you confirm the purchase. The price, currency and taxes are shown by the store before you buy and may differ by country.

Monthly and yearly subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends at the then-current price.

If the price of a subscription changes, the store will notify you as its rules require. If you do not cancel before the change takes effect, you accept the new price.

5. Free trial

The yearly plan may include a 3-day free trial for eligible new subscribers. Eligibility is decided by the store and a trial can be used only once per Apple ID or Google account. You are not charged during the trial. If you do not cancel at least 24 hours before it ends, the yearly price is charged. Any unused part of a free trial is lost when you buy a subscription or the Lifetime purchase.

6. Lifetime purchase

The Lifetime purchase is a single payment that unlocks Waken Pro without renewal. "Lifetime" means for as long as Waken Pro is offered and supported for your device and account, not for your own lifetime. If we ever stop offering the App we will try to give reasonable notice. It is tied to the Apple ID or Google account that bought it.

7. Cancelling and managing subscriptions

You can cancel or change a subscription at any time in your App Store or Google Play account settings. Cancelling stops future renewals; you keep Pro until the end of the period you already paid for. Deleting the App does not cancel a subscription.

8. Refunds

All purchases are processed by Apple or Google, not by us, so we cannot issue refunds or cancel charges ourselves. Refund requests are handled by the store under its own rules. On iPhone you can ask Apple at reportaproblem.apple.com. On Android you can request a refund in Google Play; Google commonly allows self-service refunds within about 48 hours of purchase, and after that you can contact Google Play support. These rules can change and differ by country, so check the store's current refund page.

Except as the store's rules or the law require, payments for periods already started, unused free-trial time and the Lifetime purchase are not refundable by us. Nothing in these terms limits any right to withdraw from or get a refund for a purchase that the law of your country gives you; you can use that right through the store.

9. Restoring purchases and using several devices

Your purchase belongs to the Apple ID or Google account that made it. You can restore it on other devices of the same store account with Restore Purchases on the Waken Pro screen. Purchases cannot be moved between iPhone and Android because Waken has no account of its own.

10. Alarm reliability

We work hard to make alarms ring on time, but no phone alarm can be guaranteed. Many things outside our control can stop or delay an alarm, including:

• your phone settings: silent mode, Do Not Disturb or Focus, low media volume, notification or exact-alarm permissions that are off, and battery saver or app-sleeping features;
• a low or empty battery, a phone that is switched off, or a restart before you open the App again;
• system updates, operating system bugs, restricted background activity, force-stopping the App and manufacturer-specific restrictions;
• changes to the clock, time zone or daylight saving time, or a wrong device time;
• headphones, Bluetooth speakers or other connected devices that play the sound instead of the phone;
• damage to or faults in your device.

Please finish the setup steps in the App and test your alarm before relying on it. Do not rely on Waken as your only means of waking up for critical events such as flights, medical appointments, medication, shifts or exams. Use a second alarm for anything important.

11. Missions, safety and safe exit

Missions are designed to help you wake up. Complete them only when it is safe to do so. Never use your phone while driving or in any situation where it could cause harm, and take care when walking in the dark or on stairs. If you cannot do a mission, the App offers a safe exit that uses a limited number of escapes; a last-resort way to silence the alarm is always available.

Alarms can be very loud, especially in the extra-loud mode. Keep the phone away from your ears, do not use loud alarms with headphones, and take care around babies, pets and people who are sensitive to noise.

12. Health disclaimer

Waken is a wake-up and routine tool. It is not a medical device and does not diagnose, treat or prevent any condition. Bedtime and sleep-goal features are general suggestions, not medical advice. Talk to a qualified professional about sleep or health concerns. Waken is not an emergency device.

13. Camera and image analysis

Some missions use the camera and analyze images on your device. Results can be wrong, for example in poor light, with unusual objects or for some faces, and we do not promise that a mission will always recognize what it expects. If a mission cannot be completed, use the safe exit described above. The camera is used only as described in our Privacy Policy.

14. Your content

Sounds and photos you add stay yours and stay on your device. You confirm you have the right to use them. You give us no license to them, because they are not uploaded. If you send us feedback or ideas, we may use them to improve the App without owing you anything.

15. What you may not do

You may not copy, modify, reverse engineer, decompile or resell the App; remove or bypass purchase checks, trial limits or other protections; use the App to break the law; or interfere with the App or its services.

16. Intellectual property and the name of the App

The App, its design, artwork, sounds and code belong to AlcStack Dev or its licensors and are protected by law. These terms do not give you ownership of any of it. The name "Waken" and its logo are used to identify the App. We may change the name or branding of the App at any time; these terms then apply to the App under its new name.

17. Third-party services and trademarks

Apple, the App Store, iPhone, Google, Google Play, Android and other names mentioned in the App are trademarks of their owners and are used only to describe compatibility and purchases. We are not affiliated with or endorsed by them, except that the App is distributed through their stores.

18. Apple and Google

These terms are between you and AlcStack Dev, not Apple or Google. We, not Apple or Google, are responsible for the App, its content, its support and any claims about it. If you downloaded the App from the Apple App Store, the following also applies:

• License: Apple's standard Licensed Application End User License Agreement applies to the license, and in a conflict with these terms about the license Apple's terms prevail. The license is limited to Apple-branded products you own or control, as permitted by the App Store usage rules.
• Maintenance and support: we, not Apple, are solely responsible for maintenance and support of the App. Apple has no duty to provide any.
• Warranty: if the App fails to meet a legal warranty, you may tell Apple and Apple will refund the purchase price; Apple has no other warranty obligation for the App. Any other claims, losses or costs for a failure to meet a warranty are our responsibility.
• Product claims: we, not Apple, are responsible for any claims about the App, including product liability claims, claims that it does not meet legal requirements and consumer protection or similar claims.
• Intellectual property claims: if a third party claims the App infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim.
• Legal compliance: you confirm that you are not located in a country under a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
• Third-party terms: you must comply with the terms of any third-party agreement that applies when you use the App, such as your wireless data service agreement.
• Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.

Google is not a party to these terms and has no duty to provide support for the App.

19. Disclaimer and limitation of liability

The App is provided "as is" and "as available". To the fullest extent the law allows, we do not promise that it will be uninterrupted or error-free, and we are not liable for missed alarms, missed appointments, lost time, device battery use or indirect or consequential losses that result from device settings, operating system behavior, hardware faults, third-party services or your use of the App. Our total liability for any claim about the App is limited to the amount you paid us through the store for the App in the 12 months before the claim. Nothing in these terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence or for fraud, or limits the mandatory consumer rights you have under the laws of your country.

20. Consumer rights

If you are a consumer, the mandatory consumer protection laws of the place where you live (for example in Türkiye, the EU, the UK or your US state) continue to apply to you and prevail over anything in these terms that conflicts with them, including any right to withdraw from a purchase or to a remedy for a defective digital product. You can use those rights through the store where you bought the App or by contacting us.

21. Ending use

You can stop using Waken at any time by deleting it. We may suspend or end access to the App for anyone who seriously or repeatedly breaks these terms. Sections that by their nature should continue to apply will continue after use ends.

22. Changes

We may update these terms or the App. When the terms change we will update this page and its date, and for significant changes we will tell you in the App. Continuing to use the App after a change means you accept it.

23. Governing law and disputes

These terms are governed by the laws that apply to us as the provider of the App, except that the mandatory consumer protection laws of the country where you live always continue to apply to you. If you have a problem, please contact us first so we can try to solve it. Disputes that cannot be solved are decided by the courts that have jurisdiction under the law that applies to you and to us.

24. General

If a part of these terms is found to be unenforceable, the rest stays in force. If we do not enforce a right right away, we do not give it up. We may transfer the App and our rights and duties under these terms to another party; you may not transfer yours without our consent. These terms, together with our Privacy Policy and the store terms that apply to your purchase, are the whole agreement between you and us about the App. We are not responsible for failures caused by events beyond our reasonable control. These terms are written in English; any translation is only for convenience.
